Legal Notice

These terms and conditions apply to orders for products via the website WWW.tcboo.shop. For further clarification of these terms and conditions or if in any doubt about the potential purchase please contact us in the first instance.

Seller

• The seller is Tcboo (the company) a private company registered in England who you can contact using our Contacts button.

customer

• The person or persons purchasing the product online via Website or Email

Product

• Our product contains Polyester either recycled or virgin with Elastane.
• Our dyestuff/print ink is Oekotex® certified.
• If recycled our product is covered by GRS. 
• Before purchasing our product the customer must check that the end user is or has no allergic reaction to the constituents of the fabric and or its print stuff.
• It is advisable to wash the Band prior to use, as it may still contain trace elements of a paraffin wax treatment used in the Knitting process (wash instructions must be followed to validate the customer Guarantee).
• Washing should be carried out at no more than 40 deg C. Using standard non Bio washing powder.
• The Band should not be tumble dried.
• The Band should not be bleached.
• The band should not be Dry cleaned.
• Dry using a clothes line or airer, do not dry directly on a radiator or heat source.
• Recycle. At end of life the Band should be sent for recycling in a clothing recycling system.
• Packaging, all packaging is supplied from recycled packaging suppliers where possible. Please use the circular economy and recycle.

 Orders and delivery

• Orders are processed and goods are sent within the timeframe stated at the point of purchase, with quoted delivery timeframes being an indication only, as we cannot control our delivery agents directly.
• Should goods go out of stock due to a stock error we will advise you and ask if you require an alternative or a refund. If an alternative is sought then any additional fees (if the cost of the alternative is more) must be paid before despatch.
• Goods may be in work when ordered. If this is the case we will inform you of a delay and ask whether you want to cancel or find an alternative. If an alternative is requested, any additional fees must be paid before despatch.
• Tcboo reserves the right to cancel an order before despatch and will refund any money paid.
• Customers should receive an email confirmation within three days of placing an order online. If not, they should assume the order was unsuccessful.
• Actual product colours may vary slightly from those seen on screen. This is due in part to the difference between screen colour and printed colour in natural light. Our colours are regulated under D65.
• Goods sent outside of the UK may incur duty and local tax charges. These are the responsibility of the buyer.
• Our goods are despatched by courier nominally, Post Office, DHL, UPS, Fedex.
• Force majeure events that could impact a sales contract between Tcboo and the customer include floods, hurricanes, earthquakes, fires, natural disasters, war, terrorism, government action, strikes, labour stoppages, epidemics, pandemics, utility failures, any other event that is beyond the control of Tcboo the Company. Should any of these occur then we will contact you to ask a way forward that is achievable to both parties.
• Goods remain the property of Tcboo until paid for in full.

Returns and exchanges

• Items must be returned within 14 days of receipt and be unused, unwashed and not damaged.
• If you wish to replace this returned item with an alternative, any price difference must be paid in full before shipment can be commenced.
• Customer's are requested to use a trackable return service as a returned item without proof of arrival cannot be classed as having been returned, therefore no refund or credit toward an exchange can be made.
• Goods sent from outside the UK for return  must include payment of duty and or tax where applicable. This is the responsibility of the returning customer.
• Refunds will be paid directly into the account/card from which it was taken. This can take up to 7 days.

Guarantees and cancellations

• Goods are deemed to be free from defects in material, print and workmanship for a period not exceeding 12 months from delivery.
• This Guarantee does not apply to defects from fair wear and tear, wilful damage, negligence, misuse or abnormal usage.
• You have rights to cancel the contract by giving written notice within seven days of receiving the goods. The cancellation if deemed effective on receipt and delivered goods should be returned at the customers cost.
• All terms and conditions are as governed by English Law.

Modern Slavery

• Modern slavery is a crime and a violation of human rights, including slavery, servitude, forced labour and human trafficking. These have in common the deprivation of a person's liberty in order to exploit them for personal or commercial gain.  We, as suppliers of product, are opposed to such abuses and conform to the requirements of the Modern Slavery Act 2015.

Intellectual property 

• The term Tcboo® is the trading name by which Spinney yarns Ltd is to be known. Tcboo is a registered trademark and should be treated as such.
• Patent DM/247396 relates to the Patent for a Band that can be used on a bed or chair (size dependent) as a covering (class 22/24 slings bands and bed covering). It is currently approved for use in the United Kingdom and it's Dependents, The European Union and any affiliated Islands. Other Patents are currently pending in The United States of America, Canada and Turkey.
• It is unlawful for any Company or individual to utilise the Trading name and or Patent for their own gains or to fraudulently coerce someone or something into thinking that they are dealing with this registered and patented company.
• The IP information is provided by the creator and is not liable for any misuse or misinterpretation of the information that is provided as is. The creator accepts no responsibility arising from its use unless a licence has been granted. Any action would then be taken against the licensor.
• Any infringement of the rights under the WIPO directive of use of an approved IP may result in legal action being taken against the infringing party.
• No copying or modification of the design can be accepted and any such, will result in legal action against the infringing party
• Any copying of any artwork will be deemed to have infringed copyright on said artwork and my result in legal action.
• Where a license has been issued for Tcboo® to make third party goods for sale on this website the Brands own IP rules of use must be adhered to.
